Following the submission of the Application for Arbitration (the Application), should the Centre determine the Application to ultimately be not eligible for registration under the DIAC Arbitration Rules and/or the applicable Centre’s policies, the Registration Fee will not be refunded.
*Article (1) of Appendix I to the DIAC Arbitration Rules
1.1. A request for arbitration, the introduction of a counterclaim and an application for emergency interim relief must in each case be accompanied by the applicable non-refundable registration fees specified in the Table in force on the date of the commencement of the arbitration.
1.2. The Centre shall proceed with registering and administering only those claims, counterclaims and applications for emergency interim relief with respect to which the relevant registration fee has been paid in full.
COSTS OF ARBITRATION**
In accordance with Article 2.1 of Appendix I to the DIAC Arbitration Rules in conjunction with Article 40.3 of the DIAC Arbitration Rules, the advance on the Tribunal’s fees is fixed by the Centre at the average amount calculated by reference to the minimum and maximum values indicated in DIAC Table of Fees and Costs corresponding the total of the sum(s) claimed and/or counterclaimed. In addition, a sum equivalent to 20% of the advance on the Tribunal’s fees is added to the advance on costs of the arbitration, which is intended to cover the expenses of the Tribunal.

The Centre shall fix an advance on costs of the arbitration, which is intended to cover the fees and expenses of the Tribunal and the Centre’s administrative fees. The Centre shall fix the advance on costs of the arbitration by reference to the total of the sum(s) claimed and/or counterclaimed in accordance with the Table in force on the date of the commencement of the arbitration. The Centre may, at any time during the arbitration, readjust the advance on costs of the arbitration pursuant to Article 4.2 of Appendix I.

The note is important to clear the transfer of payment for DIAC.
It is important to include the name of the payer and, if applicable, the case reference to the payment for its prompt and accurate crediting. A copy of the proof of payment should be provided, so that the respective transfer is located in the Centre’s accounts.
All payments must be free of any charges that may occur at the sending and/or receiving bank. The Centre shall bear no responsibility with regards to any currency conversions that might be applied by the sending and/or the receiving bank or to any currency fluctuations, which might overall affect the payment of fees and costs.
