In addition to the above, a sum of approximately 20% of the advance on the Tribunal’s fees is added to the advance on costs of the arbitration, which is intended to cover the expenses of the Tribunal.
Pursuant to Article 4.2 of Appendix I to the DIAC Arbitration Rules 2022, the Centre may, at any time during the arbitration, fix the fees of the Tribunal at a figure higher or lower than that which would otherwise result from the application of the DIAC Table of Fees and Costs due to the relevant circumstances. For this purpose, the Arbitration Court may take into account any such circumstances it considers appropriate, including but not limited to a fluctuation in the sum(s) claimed and/or counterclaimed, any additional claims made, any changes in the amount of the Tribunal’s estimated expenses, or any unforeseen complexity of the dispute.
